Terms of sale.
These terms govern purchases and offers made on vault.dgwcollectibles.com, operated by DGW Collectibles, Inc. d/b/a DGW Collectibles & Estates ("DGW"). By placing an order or making an offer you agree to them.
1. Listings and pricing
Each listing is for the single, specific item pictured. Prices are in US dollars. We reserve the right to correct listing errors, including price errors, before an order ships, and to cancel and refund any order affected by an error.
2. Holds
Starting checkout places a short hold on the item. Holds release automatically if payment is not completed within the stated time. A hold is not a sale.
3. Offers
An offer is a binding proposal to purchase at the stated amount. DGW may accept, counter or decline at its discretion. Once DGW accepts an offer, or a buyer accepts a DGW counter, a contract of sale exists at that price, subject to payment within the payment window shown. If payment is not completed within the window, DGW may release the item for sale to others. Buyers may withdraw an offer at any time before it is accepted.
4. Payment
Payments are processed by Stripe. Bank transfer is available on qualifying orders; the item is held for the stated period pending receipt of funds. Title passes on receipt of cleared payment.
5. Sales tax
Sales tax is collected where DGW is required to collect it, based on the shipping address.
6. Shipping and risk
All orders ship insured with tracking. Risk of loss passes on delivery. Buyers must provide an accurate, deliverable address; orders returned for a bad address are reshipped at the buyer's cost. Signature may be required on delivery.
7. Condition and authenticity
Graded items are sold as graded by the named third-party service and are verified against that service's cert database before shipping. Raw items are described to the best of our ability with photographs forming part of the description. Sealed product is sold sealed and is not guaranteed as to contents.
8. Returns
See the Shipping & Returns policy, which forms part of these terms. In short: not-as-described claims within 3 days of delivery are honoured in full; disagreement with a grade is not a defect.
9. Chargebacks and non-payment
Filing a chargeback instead of contacting us, or failing to pay for an accepted offer, may result in the account being blocked from future purchases and offers. DGW reserves the right to pursue amounts owed.
10. Limitation of liability
To the fullest extent permitted by law, DGW's liability for any claim arising from a sale is limited to the amount paid for the item.
11. Governing law
These terms are governed by the laws of the State of New York. Any dispute will be brought in the state or federal courts located in Dutchess County, New York.
